Your Data, Your Control

You retain full ownership and control of all your data processed through ETLFunnel.

1. Acceptance of Terms

By accessing or using ETLFunnel's services, including our code-driven ETL platform, documentation, and related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use our Services. These Terms constitute a legally binding agreement between you and ETLFunnel.

2. Description of Services

ETLFunnel provides a code-first data pipeline platform that enables users to:

  • Build custom ETL pipelines using Go programming language
  • Deploy and scale data processing infrastructure
  • Connect to various data sources and destinations
  • Monitor and manage data pipeline operations
  • Access IDE-like development environment with IntelliSense
On-Premise Deployment: Our platform supports true on-premise deployment, ensuring your data never leaves your infrastructure while providing unlimited scaling capabilities.

3. User Accounts and Registration

To access our Services, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use
  • Ensuring your contact information remains current

You may not share your account credentials or allow others to access your account except as explicitly permitted by your subscription plan.

4. Subscription and Billing

4.1 Subscription Plans

We offer the following subscription plans:

Basic Plan: $100/host/month - Unlimited runners, data processing, and infrastructure scaling
Pro Plan: $250/host/month - Everything in Basic plus priority support and custom connectors

4.2 Billing Terms

  • Subscription fees are billed monthly in advance
  • All fees are non-refundable unless required by law
  • You authorize automatic billing to your payment method
  • Failed payments may result in service suspension
  • Price changes require 30 days advance notice

4.3 Free Trials

We offer free trials as specified in your subscription. Trial accounts may have limited features or usage restrictions. Trials automatically convert to paid subscriptions unless cancelled before the trial period ends.

5. License and Access Rights

Subject to these Terms and your subscription, we grant you a limited, non-exclusive, non-transferable right to access and use the Services for your internal business operations.

5.1 Permitted Use

  • Use the Services within your subscription limits
  • Create and deploy ETL pipelines for your data
  • Connect to your own data sources and destinations
  • Scale infrastructure according to your needs

5.2 Restrictions

You may not:

  • Reverse engineer, decompile, or attempt to extract source code
  • Remove or modify any proprietary notices
  • Use the Services to build competing products
  • Exceed usage limits of your subscription plan
  • Share access credentials with unauthorized parties

6. Acceptable Use Policy

You agree to use our Services responsibly and in compliance with all applicable laws. Prohibited activities include:

Illegal Activities

  • Processing illegal content or data
  • Violating data protection laws
  • Infringing intellectual property rights

Security Violations

  • Attempting to breach security measures
  • Introducing malicious code or viruses

7. Data Ownership and Control

Your Data Sovereignty: You retain complete ownership and control of all data processed through ETLFunnel. We never claim ownership of your data.

7.1 Customer Data

  • You own all data you input, process, or generate using our Services
  • You control how your data is processed, stored, and transmitted
  • You may export your data at any time in standard formats
  • We will not access your data except as necessary to provide Services

7.2 On-Premise Deployment

For on-premise deployments, your data remains entirely within your infrastructure. ETLFunnel software operates locally without transmitting your data to our servers.

8. Intellectual Property Rights

8.1 ETLFunnel Property

ETLFunnel retains all rights to our platform, software, documentation, and related intellectual property. This includes:

  • The ETLFunnel platform and underlying technology
  • Documentation, tutorials, and support materials
  • Trademarks, logos, and brand assets
  • Improvements and updates to the Services

8.2 Customer Code and Pipelines

You retain ownership of ETL pipelines, transformations, and custom code you create using our platform. ETLFunnel does not claim rights to your business logic or proprietary data transformations.

8.3 Feedback and Suggestions

Any feedback, suggestions, or improvement ideas you provide may be used by ETLFunnel to enhance our Services without compensation or attribution requirements.

9. Service Level Agreement

9.1 Support

Basic Plan Support

  • Email support during business hours
  • Response within 48 hours
  • Access to documentation and guides

Pro Plan Support

  • Priority email and chat support
  • Response within 12 hours
  • Direct access to technical team
  • Training and onboarding assistance

9.2 On-Premise SLA

For on-premise deployments, availability depends on your infrastructure. We provide software updates, bug fixes, and technical support according to your subscription level.

10. Limitation of Liability

Important: This section limits our liability for damages. Please read carefully as it affects your legal rights.

10.1 Liability Cap

Our total liability for any claims arising from or related to these Terms or the Services will not exceed the amount you paid us in the 12 months preceding the claim.

10.2 Excluded Damages

We will not be liable for indirect, incidental, special, consequential, or punitive damages, including:

  • Lost profits or business opportunities
  • Data loss or corruption (beyond our control)
  • Business interruption costs
  • Third-party claims or damages

10.3 Exceptions

These limitations do not apply to our gross negligence, willful misconduct, or liability that cannot be excluded by law.

11. Termination

11.1 Termination by You

You may terminate your subscription at any time through your account settings or by contacting support. Termination takes effect at the end of your current billing cycle.

11.2 Termination by ETLFunnel

We may suspend or terminate your access if you:

  • Violate these Terms or our Acceptable Use Policy
  • Fail to pay subscription fees when due
  • Engage in activities that harm our Services or other users
  • Provide false or misleading information

11.3 Effect of Termination

Upon termination:

  • Your access to the Services will cease
  • You may export your data for 30 days
  • We may delete your account and data after the retention period
  • Outstanding fees remain due and payable
Data Export: We provide standard export formats to ensure you can retrieve your data and pipelines before termination.

12. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information.

12.1 Compliance

We comply with applicable data protection laws, including GDPR, CCPA, and other regional privacy regulations. You are responsible for ensuring your use of our Services complies with applicable laws in your jurisdiction.

12.2 Data Processing Agreement

For customers subject to GDPR or similar laws, we provide a separate Data Processing Agreement (DPA) that governs our processing of personal data on your behalf.

13. Force Majeure

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:

  • Natural disasters or acts of God
  • War, terrorism, or civil unrest
  • Government actions or regulations
  • Internet or telecommunications failures
  • Third-party service provider outages
  • Pandemics or public health emergencies

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms are governed by the laws of Delaware, United States, without regard to conflict of law principles.

14.2 Dispute Resolution

Before pursuing formal legal action, we encourage resolving disputes through direct communication. If informal resolution fails, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association.

14.3 Class Action Waiver

You agree to resolve disputes individually and waive the right to participate in class actions or collective proceedings.

15. Changes to Terms

We may update these Terms periodically to reflect changes in our Services, legal requirements, or business practices. We will:

  • Notify you of material changes via email or platform notification
  • Provide 30 days notice before changes take effect
  • Post the updated Terms with revision date
  • Maintain previous versions for your reference

Continued use of our Services after changes constitutes acceptance of the updated Terms.
